3. Payments, Deposits & Billing
Unless explicitly agreed upon in writing, our payment terms operate under the following guidelines:
- Initial Deposit: A minimum deposit (typically 50%) is required prior to project commencement for custom development and consulting projects.
- Instant Digital Delivery Services: Items such as virtual phone numbers, aged accounts, and automated growth packages require full upfront payment.
- Final Balance: Full remaining payment is required upon final staging approval before transferring root server ownership or domain launch.
4. Client Responsibilities
To ensure timely execution and sub-second page performance, clients agree to:
- Provide accurate branding guidelines, content, images, and necessary access credentials in a timely manner.
- Review and approve project milestones within designated review windows (typically 3 business days).
- Refrain from hosting illegal, harmful, or copyright-infringing material on custom-built portals.
5. Intellectual Property Rights
Upon final payment settlement, full ownership rights of custom code, graphics, and developed website files transfer completely to the client.
Build With Castro retains the right to display completed, publicly accessible work and client logos within our online agency portfolio (`buildwithcastro.tech`) and promotional case studies unless explicitly restricted via a Non-Disclosure Agreement (NDA).
6. Third-Party Platforms & APIs
Our work often integrates third-party services, APIs, and algorithms including Meta, Google, WhatsApp, Stripe, and web hosting providers.
Build With Castro is not responsible for policy shifts, algorithm updates, or service downtime initiated by third-party platforms beyond our direct technical control.
7. Service Guarantees & Scope
We guarantee technical precision, clean code architecture, 100% PageSpeed benchmark optimization, and strict alignment with initial project specifications.
While we deploy industry-leading technical SEO and ad optimization standards, ranking times and organic traffic yields depend on search engine algorithms and competitive market factors.
8. Limitation of Liability
In no event shall Build With Castro or Fidel Castro Ncharm be liable for any indirect, incidental, or consequential damages resulting from website downtime due to third-party hosting failures, client-administered code alterations, or unauthorized access to client credentials.
9. Project Termination
Either party may terminate an ongoing project agreement with written notice if the opposing party breaches these terms. In cases of termination prior to completion, the client will be invoiced for completed milestone hours.
